Q&T Research Sherbrooke Inc. (“we”, “us”, or “our”) operates the Q&T Research website (https://qtresearch.com) (the “Service”).

This Policy applies to Personal Information (as defined below) about users of our website. This page informs you of our policies regarding how we collect, use and disclose Personal Information when you use our Service. We will not use or share your Personal Information with anyone except as described in this Privacy Policy.

This policy does not apply to Personal Information about our employees, or our subcontractors.

Collection and Use of Personal Information

When using our Service, we may ask you to provide us with certain personal information, which is any information about a natural person that directly or indirectly identifies that individual (“Personal Information”). We collect only the Personal Information about you that is necessary to establish, manage and maintain our relationship with you. This collection is limited, in most cases, to the following Personal Information:   

  • Name
  • Date of birth
  • Address
  • E-mail address
  • Telephone number

We may collect Personal Information on our website and, more broadly, during your email, telephone or in-person interactions with one of our employees or representatives.

During your interactions with our team, whether in person or over the phone, you may share Personal Information about your health status to assess your eligibility for a study. If you do not participate in a study, this data will be destroyed. If you participate in a study, you will be provided with a form describing the possible use of your data, which will take precedence over this policy.

Your Consent

Your consent to the collection, use or disclosure of your Personal Information must be manifest, free and informed. It shall be given for the specific purposes and objectives identified in this policy.

Depending on the nature and sensitivity of your Personal Information, your consent may be express (such consent may be given orally, in writing or electronically) or implied (for example, when you voluntarily provide Personal Information).

BY USING THE SERVICE, YOU CONSENT TO THE COLLECTION, USE, DISCLOSURE AND RETENTION OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THIS POLICY. SO PLEASE READ IT CAREFULLY.

If you do not consent, please stop using the Service. Except where otherwise required by law, you may withdraw your consent at any time upon reasonable notice. Please note that if you choose to withdraw your consent to the collection, use or disclosure of your Personal Information, certain features of our website may no longer be available to you or we may not be able to provide you with some of our services.

Use of Personal Information

We use the Personal Information of users of the Service only for the following purposes:

  • To provide the Service and ensure its optimal functioning;
  • Identify a user of the Service and ensure the authenticity of such identification;
  • Contact you by phone or email to inform you about the study in which you have expressed interest;
  • To send you information about upcoming studies that may be of interest to you via our newsletter. You have the option to unsubscribe from our emails at any time or to contact us to request that you unsubscribe from our database;
  • Obtain statistics about the use of the Service and our products and/or services.

All of our employees who use Personal Information are bound by confidentiality obligations and have received adequate training. In addition, they may only have access to Personal Information that is necessary for the performance of their respective duties. In the event of a breach, our governance policies and practices include sanctions.

We only use Personal Information for the purposes set out above, except where we are permitted by law, in very limited circumstances, to do so without your consent.

Cookies

Your use of the Service allows us to automatically compile certain information, known as cookies, which may include:

  • Your computer’s Internet Protocol (or IP) address;
  • Your geolocation area;
  • The operating system you are using;
  • Language preference;
  • The identity of your Internet service provider;

    We may disclose Personal Information to third parties in limited circumstances permitted by law. In the table below, we summarize these circumstances and the steps we take to protect Personal Information.

We enter into contracts with subcontractors and agents in order to provide you with a service and/or improve existing services.   

A contract obliges subcontractors to:

  • Use only the Personal Information necessary to provide the service;   
  • Refrain from disclosing or communicating Personal Information without our consent;
  • Implement rigorous security measures;
  • Allow us to audit these measures;
  • Notify us immediately in the event of a confidentiality incident;
  • Destroy Personal Information at the end of a contract.

To another party in a business transaction.

Such a transaction is defined as the disposition or lease of all or a portion of our business or its assets, a change in our legal structure by merger or otherwise, the obtaining of a loan or other form of financing, or a security interest taken to secure one of our obligations (the “Business Transaction “).

Entering into a Business Transaction.

A contract obliges the other party to:

  • Use only the Personal Information necessary to complete the Business Transaction;
  • Implement rigorous security measures;
  • Refrain from disclosing or communicating Personal Information without our consent;
  • Notify us immediately in the event of a confidentiality incident;
  • Destroy Personal Information if the Business Transaction is not completed or is no longer required to complete the Business Transaction.

To the legitimate authorities.

In order to comply with a court order or order, including a valid search warrant, or a regulatory authority, we may be required to provide Personal Information.

The laws that govern these authorities require them to put measures in place to respect and preserve the confidentiality of your Personal Information.

In general, we refuse to provide access to it if the request is not legally binding.

To our lawyers or prosecutors.

In order to defend ourselves or enforce our rights, we may disclose your Personal Information in certain circumstances. 

Both the law and the mandate letters we sign require our lawyers to protect the confidentiality of all of our communications with them.

  • Where?
    As part of the provision of our Service, we may disclose Personal Information outside of Quebec, including in the following regions:
    • Canada
    • United States

Before disclosing Personal Information outside of Quebec, we will conduct a Privacy Impact Assessment.

We will only make this disclosure if the assessment demonstrates that the Personal Information will be adequately protected in accordance with generally accepted principles of the protection of Personal Information. In addition, this communication must be the subject of a written contract that takes into account all the conclusions of the evaluation.   

Security

The security of your Personal Information is important to us, but please remember that no method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

In terms of administrative measures, we have adopted policies that provide for the following:

  • The framework applicable to the use, disclosure, retention and destruction of Personal Information;
  • A process for handling complaints relating to the protection of this information.

At the technological level, we are implementing the following measures:

  • Secure Sockets Layer (SSL) protocol;
  • Access Management – Authorized Person;
  • Network monitoring software;
  • Computer backup;
  • Username/password.

Once the information is received, it is stored securely on password-protected servers located outside of Quebec, namely in the United States, to which only our employees or authorized and mandated technical support have confidentiality can have access.

Conservation

We retain Personal Information only for as long as necessary to fulfill the purposes for which it was collected, except where legal requirements or contractual interests recognized by law require us to retain it for a longer period of time. We reserve the right to establish policies for the destruction of Personal Information from time to time. Upon request, we may inform you of how long we will retain your Personal Information.

If you request the destruction of your Personal Information, we will use reasonable efforts to comply with that request as soon as possible. Your Personal Information will be deleted within 30 days of the request.

Your rights

For users of the Service, you have the following rights:

  • The right to be informed of their use, communication, retention and destruction, which is covered by this policy;
  • The right to access your Personal Information and, where appropriate, obtain additional details about how we use, disclose, retain and destroy it;
  • In some cases, the right to object, restrict or withdraw your consent to these transactions by providing reasonable notice to the email address provided at the end of this policy;
  • The right to have your Personal Information corrected if it is inaccurate or ambiguous and to have it completed when it is incomplete;
  • The right to have your Personal Information deleted, subject to our legal obligations;
  • The right to be notified of a privacy incident involving your Personal Information that may cause you serious harm. To this end, we keep a register of all privacy incidents and assess the harm they may cause.

You may exercise these rights by sending an email to the email address provided OR by contacting us by phone at the number provided at the end of this Policy. We will respond to your requests within 30 days of receipt, except where the law allows for an extension of this period.

Subject to legal restrictions, if we refuse to provide or correct your information, we will provide you with the reasons for the refusal, information about your remedies, and the applicable sections of the law.

If we refuse to rectify your Personal Information, we will allow you to provide written comments on file with respect to the Personal Information that was the subject of the refusal to rectify. We will also retain Personal Information that has been the subject of an access request for as long as necessary to allow you to exhaust the remedies available at law.

Children’s privacy

Our Service is not directed to anyone under the age of 18.

We do not knowingly collect Personally Identifiable Information from children under the age of 18. If you are a parent or guardian and you know that your child has provided us with Personal Information, Please contact us. If we learn that we have collected Personal Information from a child under the age of 18 without verification of their parental consent, we will immediately delete this information from our servers.

Changes to this Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page, which will be brought to your attention when you log in.

We encourage you to print a copy of this policy for your records and to review it regularly for any changes. Changes to this Privacy Policy are effective when posted on this page.
